Ethical Policy for the Responsible

Use of Generative Artificial Intelligence

PURPOSE

This policy establishes standards for the responsible use of generative artificial intelligence (AI) at The Unusual Agency. It applies to all employees, contractors, consultants, and partners involved in client or internal work. As an agency operating across regulated and non-regulated industries, we balance innovation with integrity, compliance, and accountability.

Core Principles

  • Human accountability remains paramount
  • Regulatory compliance is non-negotiable
  • Transparency strengthens trust
  • Accuracy outweighs speed
  • Confidentiality must be protected
  • Creative integrity must be preserved

Generative AI supports professional judgment; it does not replace it.

Human Oversight

All AI-assisted outputs must undergo human review before client delivery or publication. AI may assist with ideation, drafting, research synthesis, and workflow efficiency. It may not independently approve messaging, publish materials, validate regulatory claims, or finalize strategic decisions. Ultimate responsibility rests with designated agency professionals.Regulated Industry SafeguardsFor healthcare, pharmaceuticals, cannabis, financial services, and other regulated sectors:

  • AI must not generate unverified or implied claims.
  • All claims require independent substantiation.
  • Structured compliance review is mandatory.
  • Required disclaimers, audience restrictions, and risk categorizations must be applied.
  • Citations and references must be independently verified. Fabricated sources are strictly prohibited.

AI outputs may not bypass regulatory review protocols.

Advertising Integrity

The Unusual Agency prohibits deceptive AI uses, including fabricated testimonials, undisclosed synthetic endorsements, materially misleading imagery, or unauthorized likenesses. Any AI-generated media must comply with advertising laws and platform policies. Consumer trust is foundational to all creative execution.

Data Privacy, Storage, and Client Confidentiality

Client data protection is central to agency ethics.

  • Confidential, proprietary, or sensitive client data may not be entered into public AI systems without explicit authorization.
  • Protected health information, financial data, or regulated materials must never be uploaded into unsecured platforms.
  • Approved AI tools must meet defined data security, encryption, and privacy standards.
  • Client data storage must comply with applicable privacy laws (including Canadian privacy regulations where applicable), contractual obligations, and industry standards.
  • Data minimization principles apply: only necessary information may be processed.
  • AI prompts, transcripts, and outputs containing client information must be stored securely and treated as confidential records.

Where uncertainty exists, data protection takes precedence.

Intellectual Property and Fairness

AI-assisted outputs must be reviewed for originality and infringement risk. The agency does not knowingly replicate copyrighted materials or protected trademarks. Outputs must also be assessed for bias, inclusivity, and responsible audience targeting.

Professional Conduct and Governance

Team members must verify accuracy, uphold compliance standards, protect confidential information, and escalate uncertainty to leadership. Clients may be informed of AI use where appropriate.
